1. Introduction

Welcome to Hintly ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Hintly platform, website, and services (collectively, the "Service") available at our website. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Definitions

  • "User" means any individual who registers for or uses the Service.
  • "Credits" means the prepaid units of usage purchased by the User to access interview minutes on the platform.
  • "BYO Key" means the "Bring Your Own Key" plan where Users provide their own third-party API keys.
  • "Content" means any data, text, audio, transcriptions, or other materials uploaded, generated, or processed through the Service.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To access the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use.

5. Services Provided

Hintly provides an AI-powered interview coaching platform that includes:

  • Real-time audio transcription during interviews
  • AI-generated answer suggestions and coaching
  • Interview preparation tools and questionnaires
  • Session recording and transcript downloads

The Service is intended to assist users in preparing for and performing during interviews. It is provided on an "as-is" basis and we do not guarantee any specific outcomes, including job offers or interview success.

6. Credits and Payment

  • The Service operates on a credit-based system. Users may purchase credits to use interview minutes.
  • New users receive a free trial of 10 minutes, valid for 7 days from account creation.
  • Credits are non-transferable and are associated with the account that purchased them.
  • All payments are processed through our payment gateway partner (PhonePe/other supported gateways) and are subject to their terms.
  • Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Attempt to gain unauthorized access to any part of the Service, other accounts, or systems.
  • Reverse-engineer, decompile, or disassemble any part of the Service.
  • Use automated tools, bots, or scripts to access the Service without our prior written consent.
  • Share your account credentials with third parties or allow others to access your account.
  • Upload malicious code, viruses, or any harmful content through the Service.
  • Resell, sublicense, or commercially exploit the Service without authorization.

8. Intellectual Property

All intellectual property rights in the Service, including but not limited to the software, design, logos, trademarks, and content created by us, remain our exclusive property. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

You retain ownership of any content you upload to the Service (e.g., resumes, job descriptions). By uploading content, you grant us a limited license to process it solely for the purpose of providing the Service.

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to such processing as described in the Privacy Policy.

10. Third-Party Services

The Service may integrate with or rely on third-party services (e.g., AI model providers, payment gateways, speech-to-text services). We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of third-party API keys (under the BYO Key plan) is subject to the respective provider's terms of service.

11. Disclaimers

  • The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not guarantee uninterrupted, error-free, or secure operation of the Service.
  • AI-generated suggestions are for guidance only and may not always be accurate or appropriate. Users should exercise their own judgment.
  • We are not responsible for the outcome of any interview or hiring decision.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Hintly and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the 3 months preceding the claim.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease. Any unused credits at the time of termination due to a breach by you will not be refunded.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on our website. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
